1Accepting These Terms

By using the FOMO Stock Trading, Inc. (“FOMO,” “we,” “us,” or “our”) stock analysis app (the “App”), website, or related services (together, the “Services”), you agree to these Terms and Conditions (“Terms”). If you don’t agree, please don’t use the Services.

These Terms are a binding legal agreement between you and FOMO. We may update them from time to time. If you keep using the Services after an update, you accept the updated Terms.

2Who Can Use FOMO+

• You must be at least 18 years old (or the age of majority where you live).
• You agree to give accurate information when you register, including your name, email, phone number, username, and password.
• You are responsible for keeping your login details private and for all activity under your account.

3What FOMO+ Does (and Doesn’t Do)

• FOMO+ gives you stock analysis tools and lets you create personal watchlists.
• No brokerage access: we do not access, connect to, or view your brokerage accounts or portfolios, and we do not place trades. Everything we provide is for informational and educational purposes only.
• Not investment advice: nothing in the Services is financial, investment, tax, or legal advice. You use the Services at your own risk. Past performance does not guarantee future results, and all investing involves the risk of loss.

4Payments

Payments for subscriptions and premium features are processed securely by our payment provider, Stripe, LLC. We do not store your payment information. Stripe’s policies govern all payment terms.

5What You Agree Not to Do

• Use the Services for anything illegal or in violation of any law.
• Try to gain unauthorized access to any part of the Services or to other users’ accounts.
• Reverse engineer, copy, or distribute the App or its content without our permission.
• Upload harmful code or spam, or interfere with the Services.
• Use the Services to harass, defame, or harm others.

6Our Content

All content, logos, tools, and technology in the Services belong to FOMO or its licensors. We give you a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes.

7Ending Your Account

We may suspend or close your account at any time if you break these Terms. You can delete your account anytime in the App settings or by contacting us.

8Disclaimers and Limits on Liability

• The Services are provided “as is,” without warranties of any kind.
• FOMO is not responsible for any losses, damages, or decisions you make based on information from the Services.
• In no case will FOMO’s total liability be more than the amount you paid us in the 12 months before the claim (if any).

9Indemnification

You agree to indemnify and hold FOMO harmless from any claims, losses, or damages that result from your use of the Services or your violation of these Terms.

10Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located in Los Angeles or Orange County, California.

11Text Messages (SMS)

By providing your phone number or opting in through our website, app, or any signup form, you agree to receive SMS messages from FOMO Stock Trading, Inc. (“FOMO”). These may include account notifications, renewal reminders, alerts and triggers, customer support messages, and two-factor authentication codes.

• Message and data rates may apply.
• Reply STOP at any time to opt out.
• Reply HELP for assistance, or visit www.fomostocktrading.io.

Your SMS consent is used only for communication from FOMO. SMS consent is not shared with third parties or affiliates.
