By accessing or using the FOMO Stock Trading, Inc. (“FOMO”, “we”, “us”, or “our”) stock analysis application (the “App”), website, or related services (collectively, the “Services”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use the Services.

These Terms form a binding legal agreement between you and FOMO. We may update these Terms periodically, continued use after changes constitutes acceptance.

2. Eligibility and Account Registration

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
You agree to provide accurate information when registering (name, email, phone, username, password).
You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

3. Use of the Services

The Services provide stock analysis tools and allow you to create personal watchlists of stocks.
Important Disclaimer: Our platform does not access, connect to, or view your personal brokerage accounts, portfolios, or execute trades. All analysis is for informational and educational purposes only.
Not Investment Advice: Nothing on the Services constitutes financial, investment, tax, or legal advice. You use the Services at your own risk. Past performance is not indicative of future results. Investing involves risk of loss.

4. Payments

Payments for any premium features or subscriptions are processed securely by our third-party provider, Stripe, LLC. We do not store your payment information. All payment terms are governed by Stripe’s policies.

5. Prohibited Conduct

You agree not to:

Use the Services for any illegal purpose or to violate any laws.
Attempt to gain unauthorized access to any part of the Services or other users’ accounts.
Reverse engineer, copy, or distribute the App or its content without permission.
Upload harmful code, spam, or interfere with the Services.
Use the Services to harass, defame, or harm others.

6. Intellectual Property

All content, logos, tools, and technology in the Services are owned by FOMO or its licensors. You are granted a limited, non-exclusive, revocable license to use the Services for personal, non-commercial purposes.

7. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account through the App settings or by contacting us.

8. Disclaimers and Limitation of Liability

The Services are provided “AS IS” without warranties of any kind.
FOMO is not liable for any losses, damages, or decisions you make based on information from the Services.
In no event shall FOMO’s total liability exceed the amount you paid to us in the twelve months preceding the claim (if any).

9. Indemnification

You agree to indemnify and hold FOMO harmless from any claims, losses, or damages arising from your use of the Services or violation of these Terms.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Disputes shall be resolved in courts located in Los Angeles/Orange County, California.

11. SMS Text Messaging

By providing your phone number or opting in through our website, app, or any signup form, you agree to receive SMS messages from FOMO Stock Trading, Inc. (“FOMO”). These messages may include account notifications, renewal reminders, alerts and triggers, customer support messages, and outbound 2‑factor authentication codes.

Messaging frequency may vary. Message and data rates may apply.

You may opt out of SMS messages at any time by replying STOP. For assistance, reply HELP or visit our website at www.fomostocktrading.io.

Your SMS consent is used solely for communication from FOMO. SMS consent is not shared with third parties or affiliates.
