1Accepting These Terms

These Affiliate Program Terms and Conditions (“Affiliate Terms”) govern your participation in the referral/affiliate program (the “Program”) offered by FOMO Stock Trading, Inc. (“FOMO,” “we,” “us,” or “our”) for the FOMO+ stock analysis app and related services (the “Services”). By registering for or participating in the Program in any way — including by sharing a referral link, promo code, or affiliate materials — you agree to these Affiliate Terms. If you don’t agree, please don’t register for or use the Program.

These Affiliate Terms are a binding legal agreement between you (“Affiliate,” “you,” or “your”) and FOMO, and work together with our general Terms and Conditions and Privacy Policy. If anything here conflicts with those documents on a matter specific to the Program, these Affiliate Terms control. We may update these Affiliate Terms from time to time; continuing to participate in the Program after an update means you accept the changes.

2Eligibility & Your Account

• You must be at least 18 years old (or the age of majority where you live) to join the Program.
• You agree to provide accurate registration information, including your name, email, username, and the payment details (such as your payment email and/or payment cell phone) used to pay your commissions.
• You are responsible for keeping your affiliate account credentials private and for all referral activity associated with your account.
• We may decline, suspend, or close any affiliate account at our discretion, including for providing false information or violating these Affiliate Terms.

3How the Program Works

• We provide you with a unique referral link and/or code to share. Referrals are tracked using cookies and other tracking technology tied to your link, code, or account.
• A “qualifying referral” is a new visitor who signs up and completes the action(s) we designate as commission-eligible (for example, a paid subscription, as described in your affiliate dashboard).
• Attribution windows, cookie duration, and commission rates are set out in your affiliate dashboard and may be updated by us from time to time, effective for referrals made after the update.
• You may not refer yourself, create accounts on your own behalf to generate commissions, or otherwise attempt to artificially inflate referral activity.

4Commissions & Payments

• Commissions are calculated based on qualifying referrals as tracked in our systems, and are shown in your affiliate dashboard. Our tracking records are the final authority on referral activity and commission amounts.
• Commissions are paid out on the schedule and minimum-payout threshold shown in your affiliate dashboard, using the payment method (payment email and/or payment cell phone) you provide.
• Commissions are reversed or forfeited for referrals that are refunded, charged back, cancelled, or later found to be fraudulent, self-referred, or otherwise invalid.
• No guaranteed earnings: participation in the Program does not guarantee any amount of referrals, commissions, or income. Results depend entirely on your own marketing efforts and factors outside our control.
• You are solely responsible for any taxes owed on commissions you receive.

5Marketing Guidelines & Prohibited Conduct

When promoting FOMO+, you agree not to:

• Make false, misleading, or exaggerated claims about FOMO+, its features, or potential earnings (yours or a referred user’s).
• Represent FOMO+ as providing investment, financial, tax, or legal advice, or suggest that FOMO+ accesses brokerage accounts or places trades — it does not.
• Present yourself as an employee, officer, agent, or official representative of FOMO, or state that your content is endorsed or produced by FOMO unless we’ve agreed to that in writing.
• Use spam, unsolicited bulk messaging, misleading ads, cookie-stuffing, incentivized clicking, or any deceptive traffic-generation method.
• Bid on FOMO’s trademarked or brand terms in paid search advertising, or use domains/handles confusingly similar to FOMO’s branding, without our written permission.
• Promote FOMO+ on behalf of, or alongside, content that is unlawful, discriminatory, or harmful.

6Independent Contractor Status

You participate in the Program as an independent contractor, not as an employee, partner, joint venturer, or agent of FOMO. Nothing in these Affiliate Terms creates an employment, partnership, or agency relationship. You have no authority to make commitments or representations on FOMO’s behalf, and you are solely responsible for your own business expenses, equipment, and compliance with applicable laws (including any disclosure requirements for paid endorsements, such as FTC guidelines).

7Disclaimer

• The Program, your affiliate dashboard, referral tracking tools, and all related materials are provided “as is” and “as available,” without warranties of any kind, express or implied.
• We do not guarantee that referral tracking, the affiliate dashboard, or commission calculations will be uninterrupted or error-free, though we will work in good faith to correct verified errors.
• FOMO+ itself remains an educational and analysis tool only. As set out in our general Terms and Conditions, nothing about FOMO+ or the Program is investment, financial, tax, or legal advice, and all investing carries risk, including loss of principal.

8Liability Release & Limitation of Liability

• Release: you release FOMO, its officers, employees, and affiliates from any and all claims, damages, losses, or liability arising from your participation in the Program, including your own marketing activities, your relationships with people you refer, and any investment or trading decisions made by you or anyone you refer.
• Indemnification: you agree to indemnify and hold FOMO harmless from any claims, losses, damages, fines, or expenses (including reasonable legal fees) arising out of your marketing activities, your breach of these Affiliate Terms, or your violation of any law or third party’s rights.
• Limitation of liability: to the maximum extent permitted by law, FOMO’s total liability to you arising out of or related to the Program will not exceed the total commissions paid to you in the three (3) months before the claim arose. FOMO is not liable for indirect, incidental, special, or consequential damages, including lost profits or lost referral income.

9Term & Termination

Either you or FOMO may end your participation in the Program at any time, for any reason, with or without notice. Upon termination, your right to use referral links, codes, and affiliate marketing materials ends immediately. Commissions properly earned on qualifying referrals made before termination will still be paid out on the normal schedule, subject to the reversal conditions in Section 4; commissions are not owed for activity after termination.

10Changes to the Program or These Terms

We may modify, suspend, or discontinue the Program, or change commission structures, attribution rules, or these Affiliate Terms, at any time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, communicated to active affiliates. Continued participation after a change means you accept the updated terms.

11Governing Law

These Affiliate Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any disputes will be resolved in the courts located in Los Angeles or Orange County, California.

12Relationship to Our Other Policies

These Affiliate Terms apply specifically to your participation in the Program. Your (and your referrals’) use of the FOMO+ app and website more broadly is also governed by our general Terms and Conditions and Privacy Policy, which remain in full effect.
